Timely Update July 2026: Duration of Status Final Rule

On July 17, 2026, the Department of Homeland Security published a final rule in the Code of Federal Regulations that changes the admission framework for individuals in F-1 and J-1 status. The rule replaces the longstanding “duration of status” (D/S) system, which generally permits individuals to remain in the United States for the length of their program or activity, with admission for a fixed period of time and new requirements for extending a stay. The rule is scheduled to take effect on September 15, 2026. 

We are currently reviewing the final rule to understand how it differs from the proposed version issued on August 28, 2025 and to assess its impact on members of our international community. We are also monitoring developments closely, including the possibility of future legal challenges that could delay or block certain parts of the rule. 

We recognize that new immigration policies can cause disruption, uncertainty, fear, and concern for students, scholars, faculty, staff and their families. Considerable time has been dedicated to analyzing the proposed rule, and now that the final rule has been issued, we are working closely with Middlebury’s General Counsel, as well as international professional organizations such as NAFSA, President’s Alliance, and International Student Resource Center, to assess the final rule and develop guidance for our community.
