Timely Update on Duration of Status
Yesterday, September 14, 2026, a federal court in Massachusetts temporarily blocked the Department of Homeland Security’s new rule that would end Duration of Status (D/S) for F-1 and J-1 students and exchange visitors. The rule was scheduled to take effect September 15.
As a result, there are no immediate changes for individuals in F-1 or J-1 status. This includes no changes to the current OPT application process. Current immigration regulations will remain in effect while the court case moves forward. It is anticipated that DHS will appeal the decision.
The lawsuit was filed on August 18, 2026, by NAFSA: Association of International Educators; the Presidents’ Alliance on Higher Education and Immigration, and others.
