Human Relations Officer

The Human Relations Officer (HRO) is the administrator responsible for overseeing investigations and adjudicating complaints of unlawful discrimination, harassment, and related retaliation brought under Middlebury's Anti-Harassment/Discrimination Policy. See also Middlebury's Nondiscrimination Statement.

The HRO is also the administrator responsible for overseeing investigations and adjudicating certain complaints of sexual misconduct, domestic violence, dating violence, stalking, and related retaliation in accordance with Middlebury's Policy Against Sexual Misconduct, Domestic Violence, Dating Violence and Stalking. The HRO serves as the Title IX Coordinator's designee for the purposes of overseeing investigations and adjudicating complaints of sex discrimination (including sexual harassment and sexual misconduct) in accordance with Middlebury's policies.

Complaints under the above-referenced policies should be directed to the HRO for the program at issue (see contact information below).

Middlebury's Policy Against Sexual Misconduct, Domestic Violence, Dating Violence, Stalking and Related Retaliation

Middlebury is committed to providing a campus and workplace environment that is safe and secure for all students, staff, faculty and others who participate in Middlebury’s programs. Sexual misconduct, domestic violence, dating violence, stalking, and related retaliation are strictly prohibited under Middlebury's Policy Against Sexual Misconduct, Domestic Violence, Dating Violence and Stalking. This policy applies to all Middlebury students, faculty, and staff, as well as others who participate in Middlebury's programs and activities.

Complaints against undergraduate students should be brought to the attention of the Judicial Affairs Officer (Karen Guttentag, Associate Dean for Judicial Affairs and Student Life: 802.443.2024; kguttent@middlebury.edu). The Judicial Affairs Officer (JAO) is the administrator responsible for overseeing the investigation and adjudication of sexual misconduct, domestic violence, dating violence, stalking and related retaliation complaints against undergraduate students when they are not enrolled in other Middlebury programs at the time of the alleged misconduct. The JAO is also the Title IX Coordinator’s designee responsible for overseeing the investigation and adjudication of sexual misconduct complaints against undergraduate students in accordance with this policy.

FREQUENTLY ASKED QUESTIONS

Does the Anti-Harassment/Discrimination Policy and Policy Against Sexual Misconduct, Domestic Violence, Dating Violence and Stalking apply to all faculty, staff and students?

Yes. These policies apply to all faculty, staff, and students, as well as others who participate in Middlebury’s programs. These policies may also apply to third parties, depending on the circumstances.

Where can I obtain information about the process and available resources?

Students, faculty and staff should feel free to contact the Human Relations Officer to learn more about the process for addressing harassment, discrimination, and related retaliation matters.

Students, faculty and staff who are seeking information about the process under the Policy Against Sexual Misconduct, Domestic Violence, Dating Violence and Stalking should contact the Judicial Affairs Officer or the Human Relations Officer.

Can I talk with someone to learn more about the process without having to reveal names or other identifying information?

Yes. We encourage you to come forward to explore your options. As such, if you want to make general inquiries about policies, procedures or available resources you may do so without having to identify the alleged wrongdoer by name or by implication. Requests for confidentiality are addressed in accordance with our policies (see below).

Is help available even if I don’t want to pursue a formal complaint?

Yes. See below.

Harassment, Discrimination and Related Retaliation Cases: Depending on the circumstances, there are ways we can address harassment, discrimination and related retaliation matters without a formal investigation and adjudication. For instance, we can issue No Contact Orders, provide academic accommodations, housing changes (for persons in residence on a Middlebury campus or in connection with a Middlebury program), or other services or accommodations that are reasonably available and necessary in a particular case. In some cases, a discussion with the person at issue may be enough to address the behavior. Also, we can offer alternative dispute resolution (i.e., mediation) in appropriate cases (this will depend on the nature of the allegations, the agreement of the individuals involved in the matter, or other relevant factors such as any history of misconduct of the accused individual). We can also direct you to other available resources such as counseling.

Sexual Misconduct, Domestic Violence, Dating Violence and Stalking Cases: It is not necessary to file a complaint, participate in an adjudication process, or file a criminal complaint in order to request services or accommodations. These may include but are not limited to No Contact Orders between the parties, academic or residential accommodations, changing transportation or working situations, or providing other employment accommodations, and/or other support resources, as appropriate. Middlebury personnel will identify appropriate options and work with complainants to determine whether these services or accommodations are reasonably available and necessary in a particular case. Middlebury personnel will also direct you to other available on-campus or off-campus resources. 

Middlebury will offer and upon request provide assistance to students, employees or covered third parties in contacting law enforcement agencies. This action may be taken and these options are available regardless of whether an individual chooses to file a complaint with Middlebury. Individuals may choose to notify such agencies with or without assistance from Middlebury, or may choose not to notify such authorities.

In addition to (or instead of) Middlebury’s processes, individuals who are being or who may have been subjected to sexual misconduct, domestic violence, dating violence, stalking and/or related retaliation may have the right to obtain orders of protection, restraining orders and/or relief from abuse orders from United States courts. Middlebury will support individuals if they wish to have Middlebury’s assistance in making contact with law enforcement authorities and other external resources to seek such orders. Middlebury will respect such orders to the extent applicable. In addition, Middlebury can also impose no-contact conditions on students, employees and third parties over which it has some measure of control.

Is confidentiality guaranteed?

It depends. In general, the law recognizes and protects the confidentiality of communications between a person seeking care and a medical or mental health professional, religious advisor, or certain advocates. The medical, mental health, religious professionals and MiddSafe Advocates at Middlebury and their off-campus counterparts respect and protect confidential communications from students, faculty, and staff to the extent they are legally able to do so. These professionals may have to breach a confidence, however, when they perceive a serious risk of danger or threat to any person or property. In addition, medical and mental health professionals may be required by law to report certain crimes (e.g., any allegation of sexual and/or physical abuse of a person under 18). These exceptions to confidentiality are governed by the law of the state in which the confidential resource is located.

Confidential resources are listed in Appendix B to the Anti-Harassment/Discrimination Policy and Appendix C to the Policy Against Sexual Misconduct, Domestic Violence, Dating Violence, and Stalking.

Non-confidential resources are all faculty or staff members, including residential life staff and ombudspersons, who are not medical or counseling professionals, clergy, or MiddSafe Advocates, and are therefore not permitted to honor requests for confidentiality. Non-confidential faculty or staff who learn of an incident of discrimination, harassment, sexual misconduct, domestic violence, dating violence, stalking or related retaliation involving a student are required to report that information to the HRO or JAO. Employees with supervisory responsibility are expected to report all incidents of discrimination, harassment, sexual misconduct, domestic violence, dating violence, stalking or related retaliation involving employees to the HRO and/or to Human Resources. Be assured, however, that Middlebury handles these matters with sensitivity and discretion and that we will endeavor to protect the privacy of individuals to the extent we can do so consistent with our obligations to respond to complaints or reports under the Anti-Harassment/Discrimination Policy and the Policy Against Sexual Misconduct, Domestic Violence, Dating Violence and Stalking.

Requests for confidentiality will be evaluated in accordance with our policies, as applicable. See Section A.4 of the Anti-Harassment/Discrimination Policy and Section 3 of the Policy Against Sexual Misconduct, Domestic Violence, Dating Violence and Stalking.

What policies are in place to prevent retaliation?

Retaliation is prohibited under Middlebury's Anti-Harassment/Discrimination Policy (see Section A.3) and Policy Against Sexual Misconduct, Domestic Violence, Dating Violence and Stalking (see Section 4). Incidents of retaliation are treated seriously, and we encourage people to report any concerns about retaliation to the Human Relations Officer or the Judicial Affairs Officer (complaints against undergraduate students).
