Chinese Definitions of Crimes

In Middlebury’s efforts to obtain and provide definitions of the following crimes or terms, e.g., Sexual Assault, Dating Violence, Domestic Violence, Stalking, and Consent in reference to sexual activity, which are prohibited by Middlebury’s Policy and which may also be prohibited by law in China, listed below please find some or all of the crimes or terms as locally defined by China to the extent known by Middlebury on information and belief at this time.

Article 236 Whoever rapes a woman by violence, coercion or any other means shall be sentenced to fixed-term imprisonment of not less than three years but not more than ten years.

Whoever has sexual intercourse with a girl under the age of 14 shall be deemed to have committed rape and shall be given a heavier punishment.
Whoever rapes a woman or has sexual intercourse with a girl under the age of 14 shall, in any of the following circumstances, be sentenced to fixed-term imprisonment of not less than ten years, life-long imprisonment or death:

The circumstances of raping a woman or girls under the age of 14 being flagrant;
Raping a number of women or girls under the age of 14;
Raping a woman before the public in a public place;
Raping a woman with one or more persons in succession; or
Causing serious injury or death to the victim or any other serious consequences.

第二百三十六条以暴力、胁迫或者其他手段强奸妇女的，处三年以上十年以下有期徒刑。
奸淫不满十四周岁的幼女的，以强奸论，从重处罚。
强奸妇女、奸淫幼女，有下列情形之一的，处十年以上有期徒刑、无期徒刑或者死刑：

（一）强奸妇女、奸淫幼女情节恶劣的；
（二）强奸妇女、奸淫幼女多人的；
（三）在公共场所当众强奸妇女的；
（四）二人以上轮奸的；
（五）致使被害人重伤、死亡或者造成其他严重后果的。

Article 241 Whoever buys an abducted woman and forces her to have sexual intercourse with him shall be convicted and punished in accordance with the provisions of Article 236 of this Law.
第二百四十一条收买被拐卖的妇女，强行与其发生性关系的，依照本法第二百三十六条的规定定罪处罚。

Article 259 Whoever, by taking advantage of his functions and powers or the subordinate relationship, have sexual intercourse with the wife of an active serviceman by means of coercion shall be convicted and punished in accordance with the provisions of Article 236 of this Law.
第二百五十九条利用职权、从属关系，以胁迫手段奸淫现役军人的妻子的，依照本法第二百三十六条的规定定罪处罚。

Article 300 Whoever forms or uses superstitious sects or secret societies or weird religious organizations or uses superstition to rape a woman or swindle money or property shall be convicted and punished in accordance with the provisions of Articles 236 and Article 266 of this Law respectively.
第三百条组织和利用会道门、邪教组织或者利用迷信奸淫妇女、诈骗财物的，分别依照本法第二百三十六条、第二百六十六条的规定定罪处罚。

第二百三十七条以暴力、胁迫或者其他方法强制猥亵妇女或者侮辱妇女的，处五年以下有期徒刑或者拘役。

If taking a taxi, tell the driver to take you to 水世界. Most drivers know this place and the hospital is directly across the street. It takes about 30 minutes by taxi to get here from campus. It is less crowded, more comfortable, and feels more westernized than other hospitals in Kunming. Many of the doctors and nurses can speak some English.

This is the largest hospital in our area. They provide quality medical care, but going can be a little confusing or uncomfortable for foreign students. It is crowded and noisy and patients must walk to several different departments for medical care and payments. It is best to go with your the AD or the Director, if you choose to go here. Therapists/Counselors are also available, though there are better options for counseling. This hospital is about 15 minutes from campus by taxi and its location is known by most taxi drivers.

This clinic is handy for common/minor illnesses. It is open to international students on campus and the fee is very small. Students can get immediate treatment or advice here. It is within a 5 minute walk from the student dormitory to this clinic.

A brand new counseling center staffed with veteran counselors and coaches from the US, Germany, and China. The center itself is a little tricky to find (though close to campus), but once you make it inside the building you will notice a very pleasant, bright, and modern design. The center is supervised by Vance and Bethyl Shepperson (Ph.D., ABPP and Psy.D. respectively).
