Definitions of crimes

In Middlebury’s efforts to obtain and provide definitions of the following crimes or terms, e.g., Sexual Assault, Dating Violence, Domestic Violence, Stalking, and Consent in reference to sexual activity, which are prohibited by Middlebury’s Policy and which may also be prohibited by law in Russia, listed below please find some or all of the crimes or terms as locally defined by Russia to the extent known by Middlebury on information and belief at this time.

1) Sexual Assault (изнасилование)

Определение

Определение данному термину дается в статье 131 и 132 Уголовного кодекса РФ (далее – УК РФ):

Изнасилование (ч. 1 ст. 131 УК РФ) – половое сношение с применением насилия или с угрозой его применения к потерпевшей или к другим лицам либо с использованием беспомощного состояния потерпевшей наказывается лишением свободы на срок от трех до шести лет.

Насильственные действия сексуального характера (ст. 132 УК РФ) – мужеложство, лесбиянство или иные действия сексуального характера с применением насилия или с угрозой его применения к потерпевшему (потерпевшей) или к другим лицам либо с использованием беспомощного состояния потерпевшего (потерпевшей) наказываются лишением свободы на срок от трех до шести лет.

2) Stalking (домогательство, выслеживание)

Определение

Наиболее близкое определение в российском законодательстве – «понуждение к действиям сексуального характера» (ст. 133 УК РФ).

Понуждение лица к половому сношению, мужеложству, лесбиянству или совершению иных действий сексуального характера путем шантажа, угрозы уничтожением, повреждением или изъятием имущества либо с использованием материальной или иной зависимости потерпевшего (потерпевшей) – наказывается штрафом в размере до ста двадцати тысяч рублей или в размере заработной платы или иного дохода осужденного за период до одного года, либо обязательными работами на срок до четырехсот восьмидесяти часов, либо исправительными работами на срок до двух лет, либо принудительными работами на срок до одного года, либо лишением свободы на тот же срок.

Разъяснение

Согласно п. 15 Постановления Пленума Верховного Суда РФ от 04.12.2014 N 16 «О судебной практике по делам о преступлениях против половой неприкосновенности и половой свободы личности» в отличие от изнасилования и насильственных действий сексуального характера при понуждении к действиям сексуального характера (статья 133 УК РФ) способами воздействия на потерпевшее лицо с целью получения от него вынужденного согласия на совершение указанных действий являются шантаж, угроза уничтожением, повреждением или изъятием имущества либо использование материальной или иной зависимости потерпевшего лица.

Понуждение к действиям сексуального характера считается совершенным с момента выражения в любой форме соответствующего требования независимо от наличия согласия или отказа потерпевшего лица совершить такие действия либо их реального осуществления. Не могут рассматриваться как понуждение к действиям сексуального характера или как иные преступления против половой неприкосновенности и половой свободы личности действия лица, добившегося согласия потерпевшей на вступление в половое сношение или совершение действий сексуального характера путем обмана или злоупотребления доверием (например, заведомо ложного обещания вступить в брак и т.п.).

Russia

1) Sexual Assault

Definition

The definition of this term is provided in Articles 131 and 132 of the Criminal Code of the Russian Federation (hereinafter CCRF):

Sexual assault (Sec. 1 Art. 131 CCRF) – sexual conduct/relations involving the use of violence or the threat of violence against the victim or other persons and/or by taking advantage of a victim’s incapacitation is punishable by incarceration for a term from three to six years.

Violent conduct of a sexual nature (Art. 132 CCRF) – same-sex or other conduct of a sexual nature involving the use of violence or the threat of violence against the victim or other persons and/or by taking advantage of a victim’s incapacitation is punishable by incarceration for a term from three to six years.

2) Stalking

Definition

The closest definition in Russian statutory law is “coerced acts of a sexual nature” (Art. 133 CCRF).

Coercing a person into conventional or same-sex sexual relations or any other act of a sexual nature by means of intimidation, threats to destroy, damage, or take away property, or by estranging the victim from material or other means of support is punishable by a fine levied against the convicted in an amount not to exceed 120,000 rubles or up to one year’s wages, salary, or other income or by performing up to 480 hours of mandatory community service or up to two years of corrective labor or by compulsory labor or incarceration for a period of up to one year.

Legal Application

Under P. 15 of Resolution No. 16 issued by the Plenum of the Supreme Court of the Russian Federation on 04Dec2014 “On Judicial Practice Pertaining to Matters Regarding Crimes Against Sexual Inviolability and Individual Sexual Autonomy,” in contrast to sexual assault and forcible acts of a sexual nature involving coercion (Article 133 of the CCRF), methods used to compel the victim to provide consent include intimidation, threats to destroy, damage, or take away property, or estranging the victim from material or other means of support.

Coerced acts of a sexual nature are considered to have occurred from the moment any such demand is made or implied, regardless of whether the victim gives or withholds consent to such acts or whether they are actually performed.  Acts of a sexual nature are not deemed to be coerced or to be of any other type of crime against sexual inviolability and individual sexual autonomy if consent to engage in sexual activity was obtained through deception or by abuse of trust (for example, knowingly and falsely promising to enter into marriage and so forth).
